西安市深化畅通工程领导小组制定的《关于开展“与文明同行、做文明的西安人”交通秩序综合整顿活动的实施方案》和《关于开展机动车停车场专项整顿活动的实施方案》,已经市政府同意,现转发你们,请遵照执行。
开展以“与文明同行、做文明的西安人”为主题的交通秩序综合整顿活动,是加强交通管理,提升城市形象,为广大市民进一步营造安全、畅通交通环境的重要举措,各区县、各部门要高度重视,按照两个《方案》的要求,突出文明活动主题,认真组织实施,确保各项任务的落实。
关于开展与文明同行做文明
的西安人交通秩序综合整顿活动的实施方案

为了进一步深化畅通工程,增强广大市民的交通文明和社会公德意识,努力营造安全、畅通、有序、文明的交通环境,市政府决定从9月1日至年底,在全市深入开展以“与文明同行、做文明的西安人”为主题的交通秩序综合整顿活动(以下简称“与文明同行”活动)。
一、总体目标
“与文明同行”活动的总体目标是:通过开展广泛、深入的宣传教育,引导市民群众自觉做到文明行车、文明乘车、文明走路,“与文明同行、做文明的西安人”,广大市民交通安全、交通文明意识得到明显提高;严格执法、文明执法,通过人性化、科学化、法制化的管理,使交通违法现象得到有效遏制,交通事故明显下降,市区交通环境和交通文明程度发生根本好转。
二、实施步骤
“与文明同行”活动分三个阶段进行:
第一阶段(9月1日至10月15日),在全市开展形式多样的交通文明宣传教育活动,通过集中宣传,在全市迅速推动“与文明同行”活动的全面开展;同时,在全面整治交通秩序的基础上,通过强化警告、处罚、曝光等纠处措施,重点加大对非机动车、行人交通违法行为的整治力度。
第二阶段(10月16日至11月底),结合开展“交通文明示范单位、社区、学校、乡村”创建活动,加大宣传力度,充分发挥交通文明典型的示范作用,促进“与文明同行”活动深入开展;重点加强对公交、中巴、出租以及机关公务车、军警车等机动车行车秩序的整顿,在严格纠违的同时,坚持“抄告制度”和加大曝光力度,以规范此类车辆的行车秩序。
第三阶段(12月1日至12月底),通过持续开展宣传教育,使广大市民在积极参与“与文明同行”活动的过程中,逐步养成自觉遵守交通法规的良好交通习惯;同时,结合全市停车场专项治理活动,严格处罚违章停车,科学调流车辆,合理设置引导标识,引导机动车合理停放,全面规范市区机动车停车秩序。
三、工作措施
(一)广泛动员,深入宣传,迅速掀起交通秩序整治的热潮。
1.加大新闻宣传力度。把市民交通安全宣传教育作为精神文明建设的一项重要内容,围绕“与文明同行”活动,制定全市宣传方案,认真组织实施。要组织西安地区各大新闻媒体,通过开办宣传专栏、交通违法曝光台、交通文明典型系列报道、配发评论员文章等形式,做好整顿工作的宣传报道工作。西安日报、西安晚报和西安电视台、西安广播电台等市级媒体,每天要刊登或播放一条标语口号或一条动画形式的公益广告,定期播放交通安全专题片,大力宣传交通文明建设的典型,使社会各界和广大市民关心、支持、参与“与文明同行”活动。同时,定期召开新闻通报会,通报工作情况,并组织新闻评奖活动,鼓励和支持驻市新闻媒体深入基层,准确、及时、全面、生动地跟踪报道交通综合整顿活动的开展情况。在全社会迅速掀起学习交通安全法、自觉遵守交通法规的活动热潮。(市委宣传部和文明办具体落实)
2.以市文明办和市公安交管支队的名义致信全体市民,号召广大市民从我做起,从现在做起,积极投入到全市开展的“与文明同行”活动中来。同时组织开展以“遵守交通法规,塑造文明城市”为主题的各项活动,教育引导广大市民自觉遵守交通法规,抵制不文明交通行为。(市文明办具体落实)
3.组织全市党政机关干部积极参与到“与文明同行”活动中来,通过自身模范遵守交通法规,带动周围群众共同维护良好交通秩序。同时要不断加大对党政机关公务车辆违法行为的通报曝光力度(由市公安交管支队定期抄告、市直机关工委通报曝光),以进一步规范机关公务车辆的交通行为。(市直机关工委和市机关事务管理局具体落实)
4.开展万名交通文明志愿者街头宣传“与文明同行”活动。9月中旬到10月中旬,组织动员沿街单位群众、党政机关干部、社会团体、大学、高中学生等,组成开展万名交通文明志愿者队伍,持续在市区主要干道、繁华路段,重点纠处非机动车闯灯越线,行人横穿马路、翻越护栏等不文明交通行为。志愿者由市公安交警支队统一配发执勤证,新闻媒体进行跟踪报道。(市文明办牵头落实,市委宣传部和所辖区政府配合)
5.深入全市中小学开展“与文明同行”活动,加强交通安全教育。通过运用挂图、展板、标语宣传、上交通安全课,开展绘画、摄影、演讲、辩论、知识竞赛、文艺表演等活动,教育学生要珍惜生命安全,自觉遵守交通法规。通过教育一个学生,带动一个家庭,促进全市“与文明同行”活动深入开展。(市教育局具体落实,市文明办、市公安局、团市委等单位配合)
6.面向外来人口开展“与文明同行”活动。组织人员深入劳动力市场、集贸市场、建筑工地、火车站、长途汽车站、宾馆饭店等外来人口相对集中的区域,开展交通安全宣传教育活动,使外来人口能够了解掌握城市管理和城市交通安全知识,提高外来人口的交通文明意识。(市劳动保障局、市建委、市工商局、市公安局、市旅游局等单位要根据各自管理范围组织开展工作)
7.在城区各主要路段、主要十字设立宣传站点进行宣传,深入单位、学校、社区散发宣传材料,制作交通事故宣传展板,在市区巡回展览,同时借助新闻媒体,积极组织开展中小学生交通安全漫画比赛、“与文明同行”征文等活动,不断扩大宣传效应。(市公安交管支队具体落实)
(二)突出重点,严格管理,逐步规范各类交通参与者的交通行为。
1.加大以公交车、出租车、大货车、摩托车、三轮车等为重点的交通秩序整顿力度,特别是加强自行车和行人交通秩序以及机动车停车秩序的整顿管理力度。从9月1日起,结合市公安局“安畅”2号、3号交通集中整治行动的部署要求,科学调整街面警力布防,每个交管大队成立1支专项整顿活动小分队,采取警告、处罚、拘留、曝光、办学习班等措施,适时组织开展交通秩序专项整治活动,在全市迅速掀起“与文明同行”活动的热潮。(市公安交管支队落实)
2.开展机关公务车辆、军警车辆、运钞车、施工车辆“与文明同行”活动,杜绝此类车辆不按规定使用警灯警报器、不挂号牌、挪用牌照、乱插队、乱停车、不服从交警指挥管理等现象。同时,对上述车辆交通违法行为,继续完善“抄报(告)制度”,由违法车辆所在单位进行教育处理。(市公安交管支队牵头,市纪检、监察及部队督察部门配合)
3.在全市各中小学校的学生中实施“交通文明联系卡”制度。9月10日前,交管部门要在完善中小学校周边交通标志、标线的同时,联系市教育局向全市中小学校在校学生免费发放“交通文明联系卡”,做到一人一卡。对学生的违章行为,执勤民警严格进行批评教育,并在联系卡上作好记录。各中小学校要每月检查一次学生的联系卡,将其作为学生评优活动的重要依据。(市教育局牵头,市公安局交管支队配合)
4.在市区开展“规范化管理路口(段)创建活动 ”,运用标志标线和隔离护栏等手段,对未央路——长安路、东西大街等主要路口和路段合理渠划,将机动车、非机动车和行人严格进行分离。同时进一步完善市区主干道人行过街交通标志标线,加快行人过街自助信号灯、盲人过街蜂鸣器、非机动车道信号灯等硬件设施建设,在流量较大的路口科学规划非机动车和行人二次等待区,尽量减少机非冲突,提高路口通行能力,为市民出行提供良好的交通安全设施保障。(市公安局交管支队具体落实)
5.加快道路基础设施建设,重点在人、车较为集中的繁华区域加快建设人行地下通道和过街天桥等基础设施;加快完善背街小巷的路面改造,充分利用小街巷、小胡同开辟新的非机动车道和人行道;合理改造一批交叉路口,提高道路通行能力,方便市民出行,减轻主干道交通压力;规范道路施工,加强施工现场管理,尽量避免影响交通、妨碍市民出行;在市区主要轴线规划、开辟一批公交停车港湾,进一步规范主干道公交车进站秩序,确保交通畅通。(市规划局、市交通局、市市政管委会共同负责)
6.加强对公交、客货运司乘人员的交通安全宣传教育和各类违法行为的内部管理,组织人员维护公交站点乘车秩序,确保公交车辆进站靠边、依次停放,方便市民安全有序乘车。(市交通局具体落实)
7.清理整顿占道经营,重点整治大型批发市场周边区域,以及临街书报摊、冷饮摊、蔬菜水果摊,杜绝占路摆放广告、悬挂标语、占道洗车等现象,保障道路畅通。对自行车保管站进行摸排治理,加强对中小学门前及沿街单位占道停放非机动车的管理。9月底前将交通主干道上的自行车保管站全部迁入背街小巷,对私自移位和私自扩大经营面积的,要立即整改,严肃处理;建立健全人行道“三包”停车管理机制,建设一批标线清晰、管理规范的自行车保管站。(所辖区政府牵头,市城管执法局配合)
8.加大人行道机动车停放秩序的整顿管理力度,确保道路两侧无车辆乱停乱放。(市城管执法局、市公安交管支队牵头,所辖区政府配合)
(三)选准载体,典型引路,进一步深化交通文明创建活动。
1.强化路面秩序管理,创建一批 “交通文明示范街”。所辖区政府及各交管大队,年底以前,在辖区创建1—2条文明管理示范街,通过落实单位门前“三包”规定,依法严格管理,完善交通设施,组织志愿者维护交通秩序等手段,使路段交通秩序达到一等管理水平,促进畅通工程深入开展。
2.创建一批“交通文明示范单位、社区、学校、乡村”。所辖区政府要督促指导各单位建立健全内部交通安全宣传教育机制,发挥基层组织交通安全宣传阵地的作用,组织开展“小手拉大手”、“争做文明市民”、“共创文明城市”等系列宣传教育活动,使交通文明进单位、进社区、进家庭、进学校、进农村,提高企业、单位员工、城市市民、中小学生、农村群众的文明交通意识。市公安交管支队要在已创建的交通安全单位中,制定相应标准,评选出一批交通文明示范典型。年底以前,每个区县政府要创建5个交通文明示范单位、5个示范社区、3所示范学校、2个示范村。
3.充分发挥交通文明典型的示范作用。市公安交管支队要及时总结交通文明示范典型的经验做法,市委宣传部要组织新闻媒体进行跟踪报道,确保宣传时间和宣传版面,采取在主要媒体开办“与文明同行”系列报道、播发专题片、长篇通讯报道等形式,扩大典型示范带动作用,促进“与文明同行”活动深入开展。
四、组织领导
市政府成立“与文明同行,做文明的西安人”活动领导小组,组成人员与西安市深化畅通工程领导小组成员相同(不再另行发文)。办公室设在市公安交管支队(西安市深化畅通工程领导小组办公室),具体负责整个活动的协调、策划、宣传、整顿和督查考评等工作。从2006年1月份开始,整个活动机构不撤、力度不减、措施不变,逐步形成交通文明管理的长效机制。
五、工作要求
(一)提高认识,加强组织领导。领导小组各成员单位要高度重视此项活动,制定各自工作方案,明确目标任务,加强工作部署,落实工作措施。各单位工作方案应于9月6日前报领导小组办公室。
(二)加强监督检查,落实考核责任。对这次活动的开展情况,市文明办要将其纳入各单位精神文明建设考核的内容,活动办公室要对照方案要求,定期考核验收,确保活动取得实效。
(三)讲究工作方法,严格依法管理。各有关部门要依据《道路交通安全法》和市政府有关通告精神,对非机动车和行人的交通违法行为,坚持批评教育与从严处罚相结合,同时要教育本单位执法人员,文明执法,依法管理,提高工作能力和执法水平。
(四)加强信息反馈,深化活动开展。在活动中,各部门要及时将工作中的经验、做法和遇到的新情况、新问题,及时向活动办公室反馈,以便及时研究解决,形成政府全面负责,主管部门牵头,全员参与、任务明确、各司其职、整体推进、综合治理的工作格局,促进活动稳步深入开展。

中外合作设计工程项目暂行规定(附英文)
(一九八六年三月二十七日国务院批准)
第一条 为了加强对中国设计机构同外国设计机构合作设计工程项目(以下简称合作设计)的管理,促进合作设计活动的开展,特制定本规定。
第二条 中国投资或中外合资、外国贷款工程项目的设计,需要委托外国设计机构承担时,应有中国设计机构参加,进行合作设计。中国投资的工程项目,中国设计机构能够设计的,不得委托外国设计机构承担设计,但可以引进与工程项目有关的部分设计技术或向外国设计机构进行技术经济咨询。外国在中国境内投资的工程项目,原则上也应由中国设计机构承担设计;如果投资方要求由外国设计机构承担设计,应有中国设计机构参加,进行合作设计。
第三条 需要进行合作设计的工程项目(包括合作设计所需的外汇),按照项目管理权限,由主管部门或建设单位在上报项目建议书或设计任务书的同时,提出申请,经批准后方可对外开展工作。小型项目,按隶属关系由主管部门或省、自治区、直辖市计划委员会批准。大中型项目,按隶属关系由主管部门或省、自治区、直辖市提出审查意见,报国家计划委员会审批;其中特大型项目,由国家计划委员会组织初审,提出审核意见,报国务院批准。项目的主管部门或建设单位在择优选定外国设计机构的同时,应选定中国的合作设计机构。
第四条 外国设计机构经设计资格审查合格者,方可承担中国工程项目的设计任务。外国设计机构的资格是否合格,由项目的主管部门进行审查。审查设计资格是否合格的主要内容:(一)外国设计机构所在国或地区出具的设计资格注册证书;(二)技术水平、技术力量和技术装备状况;(三)承担工程设计的资历和经营管理状况;(四)社会信誉。
第五条 合作设计双方必须签订合作设计合同,明确双方的权利和义务。合作设计合同应包括以下内容:(一)合作设计双方的名称、国籍、主营业所和法定代表人的姓名、职务、国籍、住所;(二)合作的目的、范围和期限;(三)合作的形式,对设计内容、深度、质量和工作进度的要求;(四)合作设计双方对设计收费的货币构成、分配方法和分配比例;(五)合作设计双方工作联系的方法;(六)违反合同的责任;(七)对合同发生争议时的解决方法;(八)合同生效的条件;(九)合同签订的日期、地点。
第六条 在签订合作设计合同时,被选定为合作设计的主设计方应与项目委托方签订设计承包合同。
第七条 合作设计可以包括从工程项目的勘察到工程设计的全过程,也可选择其中某一阶段进行合作。
第八条 合作设计项目的设备选型和材料选用,经合作设计双方协商后由主设计方提出,在确保生产工艺技术或使用要求的条件下,应优先选用中国的设备和材料。
第九条 合作设计应采用先进的、适用的标准规范,合作设计双方应互相提供拟采用的范本。
第十条 合作设计双方要进行设计条件会审,并对设计质量负责。合作设计双方按合同完成设计后,送项目委托方审查认可。
第十一条 在合作设计中,外国设计机构需要的地形、地质、水文、气象、环境调查等基础资料,由项目委托方按类别向各主管部门办理审批手续,实行有偿提供。使用资料者不得向第三方转让。
第十二条 在合作设计的过程中,合作设计双方应按合同要求严格履行自己的义务,如未达到合同要求,应按合同规定承担责任。
第十三条 合作设计双方设计所得收入,应按中国有关税法规定纳税。
第十四条 香港、澳门设计机构与境内设计机构进行合作设计,参照本规定执行。
第十五条 本规定由国家计划委员会负责解释。
第十六条 本规定自一九八六年七月一日起施行。

INTERIM PROVISIONS CONCERNING CHINESE-FOREIGN COOPERATION IN THE
DESIGNING OF ENGINEERING PROJECTS
(Approved by the State Council on March 27, 1986 and promulgated
by the State Planning Commission and the Ministry of Foreign Economic
Relations and Trade on June 5, 1986)
Article 1
These Provisions are formulated to strengthen the administration of the
cooperation between Chinese designing institutions and foreign designing
institutions in the designing of engineering projects (hereinafter
referred to as "cooperative designing") and to promote the development of
cooperative designing activities.
Article 2
As regards engineering projects to be financed by Chinese investment or
Chinese-foreign joint investment, or by foreign loans, when their
designing is to be entrusted to foreign designing institutions,
cooperative designing shall be carried out with the participation of
Chinese designing institutions.
As regards engineering projects to be financed by Chinese investment, if
the designing can be undertaken by Chinese designing institutions, the
task shall not be entrusted to any foreign designing institution, but part
of the designing technology pertinent to the engineering project may be
introduced or foreign designing institutions may be approached for
consultancy on technological and economic matters.
As regards engineering projects to be constructed within the territory of
China and financed by foreign investment, the designing shall, in
principle, be also undertaken by Chinese designing institutions; if the
investors request that the designing be done by foreign designing
institutions, cooperative designing shall be carried out with the
participation of Chinese designing institutions.
Article 3
In cases where engineering projects call for cooperative designing
(including the foreign exchange needed for the cooperative designing), the
competent authorities or the units undertaking the construction project
shall, in accordance with the limits of authority for the administration
of construction projects, make an application while submitting a written
engineering project proposal or a written designing task report for
examination and approval; and only after obtaining approval can they begin
to peck for foreign cooperation. For small-scale engineering projects, the
matter shall be approved by the competent authorities or by the planning
commissions of the provinces, autonomous regions, or municipalities
directly under the Central Government in accordance with the respective
subordinative relationships. For large and medium-sized engineering
projects, the matter shall, in accordance with the respective
subordinative relationships, be examined by the competent authorities or
by the provinces, autonomous regions, or municipalities directly under the
Central Government, which shall then submit a report with their opinions
to the State Planning Commission for examination and approval. As to
extra-large engineering projects, the State Planning Commission shall
organize preliminary examination and submit a report with its opinions
concerning the examination to the State Council for approval.
The competent authorities or the units undertaking the construction
projects, while selecting the most qualified foreign designing
institutions, shall also select domestic designing institutions for the
cooperative designing.
Article 4
Only after passing an examination of designing qualifications can a
foreign designing institution be entrusted with the task of designing an
engineering project in China. The competent authorities for the
engineering project shall be responsible for examining the qualifications
of the foreign designing institution.
The examination of designing qualifications covers the following main
items:
(1) a certificate of registered designing qualifications issued by the
country or region where the foreign designing institution is located;
(2) the technical level, technical force, and the state of its
technological equipment;
(3) the record of its experiences in undertaking project designing and the
state of its operations and management;
(4) its reputation in society.
Article 5
A contract for cooperative designing shall be concluded between the two
parties in cooperation, stipulating explicitly the rights and obligations
of the two parties. The contract of cooperative designing shall include
the following main items:
(1) the names of the two institutions in cooperation, their nationality,
their head offices, and the names, positions, nationality and addresses of
their respective legal representatives;
(2) the purpose, scope and period of cooperation;
(3) the form of cooperation, and the requirements for the contents, depth
and quality of designs, and for work progress;
(4) the mix of currencies in which the two cooperating parties wish to be
paid for their designing fees, and the methods and the proportions of
distribution;
(5) the ways of business communication between the two parties in
cooperation;
(6) liabilities for the breach of contract;
(7) the ways of settling disputes over the contract;
(8) the conditions for the contract to be effective;
(9) the date and place for signing the contract.
Article 6
At the time when the contract for cooperative designing is signed, the
chief designing party selected shall sign a contract for project designing
with the entrusting party of the engineering project.
Article 7
The cooperative designing may either cover the whole process of an
engineering project, i.e., from prospecting to the designing of the
project, or just involve a particular phase of the project.
Article 8
With respect to the selection of the main types of equipment as well as
that of materials, the proposal in the matter shall, after consultation
between the two parties in cooperation, be put forward by the chief
designing party. Equipment and materials originating in China shall be
given priority in selection, on condition that they satisfy the
requirements of production in terms of technology and use.
Article 9
Advanced and appropriate standards and norms shall be adopted in
cooperative designing and the two parties in cooperation shall provide
each other with the models they plan to adopt.
Article 10
The two parties in cooperation shall have a joint check up on the
designing conditions, and both parties shall be jointly responsible for
the quality of the designs. As soon as the two parties have completed
their designing in accordance with the stipulations of the contract, they
shall submit the designs to the entrusting party for examination and
approval.
Article 11
In the course of cooperative designing, in case the foreign designing
institution requires basic data concerning the topography, geology,
hydrology, meteorology, and environment in the location of the project,
the entrusting party of the engineering project shall apply to the related
competent authorities for examination and approval in accordance with the
different categories of data, and the provision of such data is non-
gratuitous. The users of such data are not permitted to transfer the data
to a third party.
Article 12
In the course of cooperative designing, the two parties in cooperation
shall, in accordance with the stipulations of the contract, fulfil their
respective obligations to the letter; if one party fails to meet the
requirements of the contract, it shall take the liabilities stipulated in
the contract.
Article 13
The two parties in cooperation shall, in accordance with the provisions of
the tax law of China, pay taxes on the income accruing to them from the
designing work.
Article 14
Cooperative designing, undertaken by designing institutions in Hong Kong
and Macao with the designing institutions in the mainland, shall be
handled with reference to these Provisions.
Article 15
The right to interpret these Provisions resides in the State Planning
Commission.
Article 16
These Provisions shall go into effect as of July 1, 1986.
